These terms govern your use of hireballast.com and any messages you receive from Ballast Operating Co. Using the site or opting in to messages means you accept them.
01Who we are
Ballast Operating Co is a consulting practice owned and operated by Douglas Mitchell in Texas. Throughout these terms, Ballast, we, and us mean Ballast Operating Co. You means the person using the site or receiving our messages.
02What this site is
This site describes Ballast and the consulting engagements available today. Nothing on it is an offer, a quote, or a contract. Fees, scope, and terms for any engagement are set in a written proposal signed by both parties.
03Consulting only
Ballast advises, builds systems, and recommends candidates. Ballast is never the employer of record for any worker it recommends. You decide who to interview, who to hire, and on what terms. You run your own background checks, verification, and hiring standards, and you remain responsible for complying with employment law.
Placement work is a referral and consulting fee. Ballast carries errors and omissions coverage, not staffing coverage, and does not employ, supervise, or guarantee the performance of any person it recommends.
04SMS messaging program
By providing your mobile number through our chat widget or any other opt in we offer, you agree to receive text messages from Ballast Operating Co.
- Program description. We send customer care messages such as replies to your questions, appointment coordination, and follow up on an existing inquiry. We also send occasional promotional messages about services, offers, and announcements.
- Message frequency. Frequency varies based on your activity and the conversation.
- Cost. Message and data rates may apply. Ballast does not charge for the messages themselves.
- Opting out. Reply STOP to any message to stop receiving texts. You will get one confirmation and then no further messages.
- Help. Reply HELP for assistance, or contact us using the details at the bottom of this page.
- Consent is not a condition. You do not have to agree to receive texts in order to hire Ballast or receive any service.
- Carriers. Mobile carriers are not liable for delayed or undelivered messages.
- Supported carriers. Delivery depends on your carrier and is not guaranteed.
How we handle the phone number and consent you give us is covered in our Privacy Policy. In short, we do not sell it and we do not share it with third parties or affiliates for their marketing.
05Scheduling
Discovery and onboarding calls are booked through a third party scheduling tool. Booking a call creates no obligation on either side. We may reschedule or decline a call.
06Your conduct
Do not use this site or our messaging to break the law, to harass anyone, to send malicious code, or to scrape, probe, or disrupt the service. We may end access or messaging at any time.
07Intellectual property
The Ballast name, wordmark, load line device, copy, and page design are owned by Ballast Operating Co. Do not copy or reuse them without written permission. Materials produced inside a paid engagement are owned by the client as set out in that engagement's agreement.
08No warranty
This site and our messages are provided as is. We make no warranty that the site will be uninterrupted or error free, and no warranty about outcomes described on it. Business results depend on factors outside our control.
09Limitation of liability
To the fullest extent the law allows, Ballast Operating Co and Douglas Mitchell are not liable for indirect, incidental, special, or consequential damages arising from your use of this site or our messaging. Where liability cannot be excluded, it is limited to the amount you paid Ballast in the three months before the claim arose.
10Governing law
These terms are governed by the laws of the State of Texas, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts located in Texas.
11Changes
We may update these terms. The effective date at the top of this page shows when they last changed. Continuing to use the site or our messaging after a change means you accept the updated terms.
